Abstract:
European Space Agency(ESA)ensures Europe's independent status in space activities and at the same time promotes the economic and industrial development in Europe. By studying the background as well as the legal mechanism of ESA, one can see that in addition to the process of European integration which could be considered as the supportive factor of ESA's success, another factor is the implementation of several important legal measures. And these legal measures are:affirming the(exclusively)peaceful use of outer space; focusing on space science and technology; confirming the "fair return" principle; encouraging space commercialization and privatization; and authorizing freedom to the member states in cooperation as well as creating comprehensive cooperation forms with the non-member states. These successful experiences of ESA are meaningful to the space cooperation activities of the other geographic territories. As the only inter-governmental organization for space cooperation in Asia, Asia-Pacific Space Cooperation Organization(APSCO)is established by learning from the legal measures of ESA. However, its achievements are unsatisfactory compared with ESA. In order to further the development of Asian space cooperation, APSCO should coordinate its legal measures based on considering the territorial particularities and the successful experience of ESA.
