Abstract: Crime constitution system has diverse structural differences, but all achieve the result of confirm the crime. The connotation of the system stresses the subjective aspect of criminality, and highlights of the effect of objective aspects on subjectivity, focusing on the prevention of criminal personality, reflecting progressive thinking and including a reasonable allocation of the burden of proof. The world's three main systems of crime constitution stress on subjective cognizance throughout, while taking into account the objective aspects, clarifying the criminal procedure law and criminal substantive law correctly in criminal cognizance of the respective role. They are close to public opinion and truth, the reasonable interpretation of which can play a positive role in criminal investigation. The system of constitution of crime is only methods and tools, without inherent merits, whose effects depend on proper understanding.
