Abstract: Although the Company Law(Revised Draft) has a large length of the existing company law involving seven aspects of additional article, modification, but failed to clearly show the value and function positioning of China’s future company law. What kind of company law a country needs is not immutable, but changes with the needs of The Times, and adjusts its value orientation accordingly. What kind of company law does our country need after all? Both “regulatory company law” and “autonomous company law” are out of time. China’s future company law should be “promoting service company law”, and the corresponding value sequence must be efficiency first, giving consideration to fairness and transaction security. Company law of the change should be around the value function, abolish the outdated and inefficient stipulate, fill the blank of the loopholes and innovation norms, balanced the interests of the company and its stakeholders, innovation and development for company, strengthen competition to create a good business environment, and promote social and economic sustainable, high-quality development in china, realize the established strategic objectives.
