Abstract:
Influenced by factors such as the broadening of employment options, the strengthening of market dominance, and the effectiveness of digital technology empowerment, the problem of negotiation imbalances in the labor market under the platform economy became increasingly prominent. Collective labor rights have important instrumental value in solving the problem of negotiation imbalances in the labor market, but the exercise of this right must be based on the presence of labor relations. This shackle should be broken, and the collective labor rights should be applied to the platform practitioners under the non-standard labor relations. Firstly, it is necessary to clarify the positioning of legislation, expand the scope of subjects enjoying this right by modifying the collective labor law, and broaden the scope of exemption of this right by modifying the anti-monopoly law. Secondly, it is necessary to promote organizational construction, set up industry unions for the platform practitioners, and accelerate the development of intelligent trade unions by a variety of means. Finally, it is necessary to clarify the key points of collective bargaining of trade unions, including service pricing and platform royalty, occupational health protection, protection of practitioners’ data.
