风险社会视域下环境规制模式的困境与超越

    Dilemma and Transcendence of Environmental Regulation Model in the Risk Society

    • 摘要: 风险社会中,以环境危险为对象的“命令—控制”模式,在一定程度上导致了对环境风险认识的欠缺,并带来规制正当性诘问,同时该模式中有限的社会参与和利益表达的不顺畅,也与风险社会的规制需求形成了张力。在风险社会中环境规制模式的选择应该考虑风险规制的特殊性,并契合社会发展需要,在全面认识环境风险的基础上,通过沟通协商程序,促进利益的充分表达,推动规制的周延与完善。为此,应该引入合作规制模式,其不仅可以实现环境风险规制的内在需求,补强规制的正当性,而且也契合了中国全过程人民民主的需要,具有充分的可行性。环境合作规制模式在中国的发展,应该以社会治理体系的完善为方向,以沟通协商机制的建立为核心程序,并通过利益衡量的方法和利益诉求的识别与回应予以充分保障。

       

      Abstract: In the risk society, the “command-and-control” model, which takes environmental risks as its object, leads to the lack of understanding of environmental risks and brings about the question of the legitimacy of regulation, and at the same time, the limited social participation and the poor expression of interests in this model also form a tension with the demand for regulation in the risk society. The choice of environmental regulation model in the risk society should take into account the special characteristics of risk regulation and meet the needs of social development, on the basis of a comprehensive understanding of environmental risks, through the communication and consultation process, to promote the full expression of interests, and to promote the circumscription and improvement of regulation. To this end, the cooperative regulation model should be introduced, which not only realizes the intrinsic needs of environmental risk regulation and strengthens the legitimacy of environmental regulation but also meets the needs of China’s whole process of people’s democracy, with full feasibility. The development of the cooperative environmental regulation model in China should be oriented towards the improvement of the social governance system, with the establishment of a communication and consultation mechanism as the core procedure, and fully safeguarded through the method of measuring interests and the identification of and response to interests.
