摘要: 电子邮件能否作为证据使用,其证明力如何,学术界一直存有争议。作者通过分析认为,电子邮件可以作为合法的诉讼证据形式使用,但电子邮件作为证据形式有三种不同形态,对不同形态的电子邮件证据形式应做不同的对待。

Abstract: it ' s long been disputed among the academia that whether email can be used as evid ence and how is the testimonial validity.By analyzing,the author believes that e mail can serve as the legal litigant evidence and it comes in three different fo rms that should be disposed differently.
