Abstract: Began with the debate between intention of criminal punishment doctrine and the doctrine of retributive punishment,the thesis points out that the non-penalization punishment accords with the legal principle of justice,rationality and legality.It not only conforms to the fundamental criminal law’s values,but also meets the needs of criminal law’s modernization movement.
