Abstract:
Shipping smear damage compensation responsibility restriction is one relatively special legal system in marine law. This article first gives an introduction to the international treaties pertinent to shipping smear damage compensation responsibility restriction and then comments on relevant legislation in America and Canada. Through an analysis of the conditions of shipping smear damage compensation responsibility restriction, and combining the judicatory practice in China, this article determines the deficiencies of relevant legislation in China and eventually proposes some possible approaches that are helpful for this legislation in China.
