Review of Tradition——A New Perspective on the Legal Culture of Confucianism

摘要: 自从19世纪西方列强打开中国大门之后,儒家法文化便受到西方法文化等多方面的巨大冲击。然而,在这一百多年里,儒家法文化并未因此冲击而消失。而反思一下当前法治建设实践中存在的问题,我们会发现进行法治建设是不能割裂传统的;而且儒家法文化中也含有很多合理内核,再加上全球化的推动,儒家法文化也在发展。所以,我们需要重新认识儒家法文化,纠正以前的错误观点。

Abstract: Ever since western powers landed on the soil of China in the 19th century, the legal culture of Confucianism has beenexperiencing the impact of western legal culture from many aspects. However, in the past one hundred year or so the legal culture ofConfucianism has not disappeared due to these impacts. A new perspective on the current legal construction and implementationurges a review of the legal culture of Confucianism, and suggests the incorporation of the core values of Confucianism into our legalsystem. A review of the legal culture of Confucianism redefines its nature and corrects our views on relevant issues.
