论抵押权的性质

    The Nature of Mortgage Right

    • 摘要: 关于抵押权的性质,在法学界存在很多争论。传统的民法理论认为抵押权是担保物权,但根据我国现行立法的规定来看,抵押权不是典型的担保物权,而是具有债权的某些特征。因为抵押权没有所有权那样最终的支配力,也没有用益物权那样的现实支配力。此外,抵押权也不具有优先受偿和物权请求权的效力。根据传统的物权和债权的分类标准,已经很难对其定位,因为抵押权具有物权和债权的双重属性。将抵押权规定为物权或者债权,在某种程度上是由于立法政策决定的。

       

      Abstract: There are many arguments about the nature of mortgage right in legal studies.Mortgage right is a vouch right in the traditional theories of civil law.However,mortgage right,having some characteristics of debt right,is not typical of vouch right according to China's existing legislatures,because it has neither the ultimate dominance of ownership nor the real control of usufruct.In addition,mortgage right has neither the first compensated right nor the claim force of real right.It's difficult for us to classify the mortgage right according to the traditional classification standards of real right and debt right,because mortgage right has the dual nature of both real right and debt right.Classifying mortgage right into real right or debt right is to some extent based on legislature policies.
