摘要: 《科技资源共享法》的立法目的,因科技资源本身和科技资源主体而具有双重性,其中应以保护科技资源共享主体的合法权利为第一目的。要注意通过对科技资源主体“产权的界定”和“行为的规制”来促进科技资源共享。在政治层面,通过立法要能促进科技进步;在技术层面,通过立法要厘清科技资源发现者、持有者和使用者之间的权利和义务关系。立法时单一、双重和多重立法目的因规制对象的不同而各异。Abstract: The legislation of Technology Resource Sharing Law represents a case study of the dual purposes of legislation.This Law defines technology sharing from both political and technical perspectives,and demonstrates the different approaches of legislation.
