从“亲亲相隐”制度看中国传统法律思想的基础——兼论“亲亲相隐”制度于当代重构之法律思想基础
A View of the Base of Chinese Traditional Laws from the “Obviation of the Relatives” System

摘要: “亲亲相隐”制度是我国传统社会的一项重要的法律思想,是传统社会中礼治与儒家文化相结合的产物。而在当代许多国家都普遍设立了关于亲属间相容隐的制度时,这一制度在我国的刑法和刑事诉讼法领域却是一个空白,但完善这一制度又是必要的。文章通过对传统“亲亲相隐”原则在制度和理念上的分析,得出在传统与现代的法律理念之间,要重构“亲亲相隐”制度,应如何考虑对建构这一制度在思想基础上的取舍。Abstract: The "Obviation of the Relatives" System was an important code of Chinese traditional laws. It is the blended code of the "rule of li (respectfulness)" and the Confucian culture. Although at present, many countries have established the "Allowrance or Obviation of the Relatives" System, China has remained a striking lacuna in the field of criminal law. Thus it is necessary to establish such a complete law system in China.
