论法治背景下村民自治之障碍与消解

Conflicts and Dissipation between Rule by Law and Self-administration of Villagers

摘要: 村民自治与法治作为我国社会存在的两种不同治理方式,存在着一些冲突,主要体现为自上而下的法治与自下而上的村民自治在治理范围上的冲突和作为“普适性知识”的国家法律与作为“地方性知识”的村民自治规范在治理内容上的冲突。在依法治国的过程中实行村民自治,我们需要收缩国家权力在农村社会的存在,为村民自治提供成长的空间。同时,国家法律与自治规范需要进行双向的良性互动,以消除它们之间所存在的冲突。

Abstract: There are some conflicts between rule by law and self-administration of villager.One is a conflict of administration range between them.The other is a conflict of administration content between national law and self-administration criterion.In the process of rule by law,national power should exert little influence on the countryside to make sufficient room for self-administration of villager.In addition,some benign interaction should are done to dissipate their conflicts.
