晚清英美对《大清律例》的认识与研究

    The Study of "Laws of Great Qing" in Britain and America in Late Qing Dynasty

    • 摘要: 西方社会关注《大清律例》始自马戛尔尼使团访华。小斯当东更是将之于1810年翻译成英文。随后在近百年中,英美人士对《大清律例》的认识和研究不断深化,这不但促进了英美人士了解中国法律制度,而且也为其攫取在华利益提供了方便。与西方在华利益和西方社会思潮变化相一致,英美人士在不同时期对《大清律例》的关注点不同,其认识和评价也是各异。

       

      Abstract: From the Macartney Mission to China, western world had begun to pay attention to "DA QING LU LI" or "Laws of Great Qing". George Thomas Staunton translated it into English in 1810. From then on, British and American scholars further had been increasingly doing researches on it, which not only facilitated their understanding of the Chinese legal system, but also helped the process of the Western invasion of China. Consistent with Western interests in China and changes in Western social thoughts, they had studied this law book with different focuses at different times, ensuing different understandings and evaluations.
