Abstract:
The national space legislation in mainland China can be divided into two parts: one is the military space legislation, and the other is the civil space legislation. Currently, the legislation concerning space activities in main space-faring nations reflected the following three trends: firstly, most space-faring nations adopted the legislative model of basic space legislation added by several supporting regulations; secondly, all these nations converted the relevant international obligations under international law into domestic law; finally, all these nations' space legislation reflect the trends and emphases in their policy. The existing space legislation in mainland China has numerous deficiencies. In view of this, only on the basis of learning from the legislative experiments of the main space-faring nations and considering the actual situation in our country in the meanwhile, we could draw up a comprehensive space legislation which provides the necessary legal frame for the Chinese space activities in the future.
