Abstract:
On the basis of modern political philosophy, modern concept of human rights has three fundamentals: individual is the subject of the human rights; civil rights are the concrete manifests of human rights; the value of human rights has absolute universality. However, the modern concept of human rights is facing challenges. Based on the review of classical political philosophy, it can be found that the subject of human rights is the integration of individual and community (nation as the largest community); the manifestation of the contents of human rights is the integration of civil rights and state power, signifying personal existence and community existence respectively; the value of human rights has absolute locality.
