法治理念、法学教育与法律现代化

Legal Ideas, Legal Education and Modernization of Law

摘要: 法治理念与法律现代化是建设法治国家的前提与路径,而法学教育又是确立和传播法治理念,推动和实现法律现代化的重要的基础。西方的经验与中国的实践均已充分说明,法学教育与法治理念之间有着相辅相成的密切关系,同时,两者又是法律现代化的重要组成部分。可以说,一国的法律现代化,既需要法学教育的发展与成熟,又需要法治理念的确立与传播,法学教育是孕育和传播法治理念的温床与载体,法治理念则是法学教育的核心与基础。因此,建设法治中国,必须高度重视法治理念与法学教育。

Abstract: Legal ideas and modernization of law are the bases for the construction of the rule of law in China. It can be concluded from Western and China's legal histories that legal education is closely related with legal ideas, and both of them are the important parts of the modernization of law. On one hand, legal education creates and spreads legal ideas; on the other, legal ideas are the core and basis of legal education.
