中国民用航空器物权登记制度:成就、问题与完善

    The Civil Aircraft Property Registration Systems in China:Achievement, Problems and Perfection

    • 摘要: 民用航空器物权登记制度是便利民用航空领域财产交易的基本保障,对于普遍倚重融资支持的航空产业发展具有重要意义。依据1995年《中华人民共和国民航法》建立起来的中国民用航空器物权登记制度,为中国企业引进民用航空器的融资交易提供了国内法上的保证。但该制度在10几年的运行中也逐渐暴露出几个突出问题,如难以涵盖当今航空领域的财产交易实践,与《中华人民共和国物权法》等法律规定难以衔接等。为民航事业的进一步发展,中国必须对现有的民用航空器物权制度进行改革与完善。其中,最紧迫的两个举措是:扩充可登记航空器物权的范围和扩充物权客体的范围。

       

      Abstract: The civil aircraft property registration systems are essential for facilitating property transactions in civil aviation area, and they also play a significant role in the development of aviation industry that heavily relies on the financial support. In China, the systems of civil aircraft property registration were established under the civil aviation law of 1995, and they secured the financial transactions through which Chinese airlines imported aircrafts. However, some problems, such as incompatibility with the practice of current aircraft property transactions, incompatibility with the property law in China, were exposed. For the future development of civil aviation industry of China, reform on the civil aircraft property registration systems must be carried out. And the most urgent measures for reform involve two expansions: the categories of property rights on aircraft and the objects of property rights.
